Prearrest Delinquency Citation Utilization Reports

Florida Statute § 985.126(5)(2024) requires the Department to “…provide a quarterly report to be published on its website and distributed to the Governor, President of the Senate, and Speaker of the House of Representatives listing the entities that use prearrest delinquency citations for less than 70 percent of first-time misdemeanor offenses.”  The statute was updated for 2025 to raise the reporting threshold to 80%.

Statute permits local jurisdictions to exclude certain offense types.  For the purposes of this reporting, however, the Department calculates the utilization measure based on § 985.12(2024) that allows all first-time misdemeanors, apart from firearm misdemeanors, to be issued a civil citation.
